MARKA respects your privacy
This policy explains how we process the personal data of people who visit markastudio.it, contact us, or receive WhatsApp messages sent through our messaging platform. We keep it simple: if anything is unclear, write to us at info@markastudio.it.
1. Who we are
MARKA is the brand under which EBCC S.R.L.S. operates, with registered office at Via Ponte di Tappia 62, 80133 Naples (NA), Italy, VAT and tax code 09939541216.

2. What data we process
• Data you give us: name, email, phone number, company name and anything you write to us through forms, email or WhatsApp.
• Browsing data: IP address, browser and device type, pages visited. Some analytics tools run only with your consent, which you give or refuse through the cookie banner.
• Data processed via WhatsApp: phone number, WhatsApp profile name, message content, date and time, delivery and read status. When the service is connected to a business’s management system, also the data needed for the service you requested, such as the name, dates and property of a booking.
3. Why we process it and on what legal basis
• Replying to your requests and preparing a project proposal: pre-contractual measures taken at your request (Art. 6(1)(b) GDPR).
• Providing the agreed services and managing our relationship: performance of a contract (Art. 6(1)(b) GDPR).
• Meeting tax and legal obligations: legal obligation (Art. 6(1)(c) GDPR).
• Website statistics with non-technical cookies: consent (Art. 6(1)(a) GDPR), which you can withdraw at any time.
• Sending you updates and promotional communications: consent (Art. 6(1)(a) GDPR), which you can withdraw at any time.
• Protecting the website and our systems from abuse: legitimate interest (Art. 6(1)(f) GDPR).
4. Our WhatsApp platform and the businesses we serve
We design and operate a platform that lets businesses communicate with their customers on WhatsApp, through Meta’s WhatsApp Business Platform. Through it we send, for example, confirmations, reminders, arrival instructions, online check-in requests and answers to frequently asked questions.
Who decides about your data. When you receive a message from a business that uses our platform, that business is the data controller: it decides why and how to contact you. We act as data processor (Art. 28 GDPR), follow its instructions and use the data only to provide the service. To exercise your rights you can contact the business or write to us, and we will forward your request.
The guesthouses Il Chiattillo, La Dimora and Aperture belong to EBCC S.R.L.S.: for their guests, the data controller is EBCC S.R.L.S.
What messages you receive:
• Service messages linked to an existing relationship, such as a booking. They do not require separate consent, because they are needed to provide the service you requested.
• Promotional messages: only if you have agreed to receive them on WhatsApp.
How to stop receiving messages. Reply STOP at any time, or block the contact on WhatsApp. We record your choice and will no longer contact you for promotional purposes.
Automated replies. Some replies may be generated automatically from information written by the business. Payments, changes, cancellations and sensitive requests are always handled by a person.
5. Who we share data with
We do not sell or rent your data. We share it only with providers that help us deliver our services, bound by data processing agreements:
• Meta Platforms Ireland Ltd., provider of the WhatsApp Business Platform, to send and receive messages;
• Supabase, to store platform data on servers in the European Union;
• Google Ireland Ltd., for email, working documents and website statistics;
• Framer, to publish this website;
• tax and legal advisors, for legal obligations;
• public authorities, when required by law.
6. Transfers outside the European Union
Some providers, such as Meta and Google, may also process data outside the European Union, in particular in the United States. In these cases the transfer relies on the EU-US Data Privacy Framework or on the Standard Contractual Clauses approved by the European Commission.
7. How long we keep data
• Contact requests that lead nowhere: 12 months.
• Client and supplier data: for the duration of the relationship, then 10 years as required by tax law.
• WhatsApp messages and platform data: for the duration of the service, then 24 months, unless the controlling business instructs otherwise.
• Consents and withdrawals: for as long as they may be needed to prove your choice.
• Browsing data: according to the periods shown in the cookie banner.
8. Your rights
You can ask us at any time to:
• access your data and receive a copy;
• correct or delete it;
• restrict processing or object to it, including marketing;
• receive it in a machine-readable format (portability);
• withdraw a consent already given, without affecting processing carried out before.
Write to us at info@markastudio.it: we reply within 30 days. You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la protezione dei dati personali, www.garanteprivacy.it).
9. Children
Our services are not directed at people under 14 and we do not knowingly collect their data.
10. Changes to this policy
We may update this policy when our services or the law change. The date at the top shows the latest version. If changes are significant, we highlight them clearly on the website.
